Welcome to TradePesa — a digital marketplace, real-money trading platform, and trading simulator. By accessing or using our website, app, or services, you agree to the following Terms of Service.

Please read them carefully. If you do not agree, do not use the platform.

1. Overview

TradePesa provides users with the ability to:

  • Create and trade tokenized digital items, in both a free Practice Mode and a real-money Live mode
  • Deposit and withdraw real Kenyan Shillings (KES) via M-Pesa, converted to and from K$Coin
  • Participate in a user-driven marketplace using K$Coin
  • Optionally pay a fee to list an existing Live token as a real, permanent asset on the Solana public blockchain
  • Participate in optional features such as HODL, Challenges, and referrals

TradePesa does not offer regulated brokerage, banking, or investment advisory services. Live mode involves real money and real risk of loss.

2. Eligibility

To use TradePesa, you must:

  • Be at least 18 years old
  • Have full legal capacity to enter into contracts
  • Use the platform for lawful purposes only

Accounts found violating these terms may be suspended or terminated. We may require identity or M-Pesa verification before allowing real-money transactions.

3. Account Responsibilities

You are responsible for:

  • Keeping your login details secure
  • All activity under your account
  • Reporting suspicious or unauthorized use immediately

TradePesa is not liable for losses due to compromised accounts, except where caused by our own security failure.

4. Platform Currency & Real Money

TradePesa uses a proprietary digital token, K$Coin, for transactions within the platform.

  • K$Coin is not legal tender and has no guaranteed value outside TradePesa
  • In Practice Mode, K$Coin is purely virtual and cannot be withdrawn or exchanged for real money
  • In Live mode, real KES deposited via M-Pesa is converted to K$Coin, and your K$Coin balance may be withdrawn back to KES via M-Pesa, subject to fees, limits, and verification in effect at the time
  • TradePesa is not a bank or licensed financial institution. Balances are not covered by any deposit insurance scheme

We reserve the right to adjust conversion rates, fees, token rules, or usage terms at any time.

5. Item Listings & Trading

Users can list digital or tokenized items for trade. You agree that:

  • You have the right to list and sell the item
  • Items must comply with TradePesa guidelines
  • Prices are set entirely by an internal trading algorithm reacting to activity within TradePesa's own platform — not by any external market — and may fluctuate significantly

TradePesa does not guarantee the value, authenticity, liquidity, or profitability of any item, in either Practice or Live mode.

6. Demo Trading (Practice Mode)

The platform offers simulated trading for educational purposes only, using virtual K$Coin.

  • All trades in demo mode use fake currency with no cash value
  • No real-world financial gain is promised or possible from Practice Mode
  • This mode is not a financial service or investment tool

Any resemblance to real trading performance is purely for learning purposes.

7. Live Mode

Live mode allows real KES, deposited via M-Pesa, to be traded as K$Coin against user-created tokens. By using Live mode, you accept that you may lose some or all of the money you deposit, that TradePesa does not guarantee any return, and that you are solely responsible for your own trading decisions.

8. Real Blockchain Token Listing (Solana)

Creators of Live tokens may optionally pay a fee to mint their token as a real SPL token on the Solana blockchain. This feature:

  • Is separate from, and does not affect, the token's normal trading on TradePesa
  • Results in a token custodied in a TradePesa-controlled wallet, not a personal wallet you control
  • Does not create a trading market on Solana by default — the token may not be tradeable or sellable outside TradePesa unless a liquidity arrangement is separately agreed with TradePesa
  • Involves irreversible blockchain transactions once completed

Separately, creators of Live tokens may also pay a fee to launch their token on Solana's real open market via a third-party bonding-curve program (Meteora Dynamic Bonding Curve). This feature:

  • Creates genuine on-chain liquidity, making the token buyable and sellable by anyone with a Solana wallet, on venues such as Jupiter, DexScreener, or Birdeye
  • Is separate from, and does not affect, the token's normal trading on TradePesa or the Blockchain Listing feature described above
  • Is fully custodial: the pool is created and administered by a TradePesa-controlled wallet, not a personal wallet you control
  • Is permanent and irreversible once created

9. HODL, Challenges & Referrals

TradePesa may offer optional features including HODL (a price-prediction game where K$Coin, including real-money-derived K$Coin, may be staked and lost), time-limited Challenges with K$Coin rewards, and a referral program. These features may be modified, suspended, or discontinued at any time, and TradePesa may withhold rewards obtained through abuse or fraud.

10. AI Assistant

Our in-app AI assistant may use a third-party AI service to process your messages and generate responses. Do not share sensitive information such as passwords or M-Pesa PINs with the assistant. Its responses are general guidance only, not financial or legal advice.

11. Prohibited Activities

You may not use TradePesa to:

  • Commit fraud or impersonation
  • List illegal or offensive content
  • Manipulate item or token prices, wash-trade, or use bots/multiple accounts unfairly
  • Harm, harass, or mislead other users
  • Use the platform for money laundering or other illegal financial activity

We reserve the right to remove content, withhold funds under investigation, or ban users violating these rules, and to report suspected illegal activity to relevant authorities.

12. Ownership & Intellectual Property

All platform content — including software, branding, and layouts — is owned by TradePesa. Users retain ownership of their original creations, but grant TradePesa a license to display, list, and promote them within the platform.

13. Termination

We may suspend or terminate your account if you violate these terms, abuse the platform, or pose a legal or security risk. You may request account deletion at any time by contacting support, subject to resolution of pending withdrawals or blockchain requests.

14. Disclaimers

TradePesa is provided "as is" and "as available." We do not guarantee profit or earnings from item or token trading, continuous access or availability, or the accuracy of market data or charts. We are not liable for losses from platform use or user activity, except as required by law.

15. Governing Law

These Terms are governed by the laws of Kenya. By using TradePesa, you agree to resolve any disputes in Kenyan courts or through arbitration where applicable.

16. Community Features (Profiles, Following & Posts)

TradePesa offers optional community features: public user profiles (visible to anyone, including logged-out visitors, at a URL based on your username), the ability to follow and be followed by other users, and the ability to submit community posts. You agree that:

  • Your username, bio, and the tokens you've created may be shown publicly on your profile
  • Community posts you submit may be automatically reviewed by an AI moderation system and, in some cases, a human moderator, before publication, and may be rejected if they violate these Terms or our community guidelines
  • Once approved, a post is publicly visible and may be indexed by search engines; you remain solely responsible for its content
  • We may remove any community post or restrict your profile at our discretion for violations of these Terms
  • We may send you in-app or browser push notifications (where permitted) about relevant activity, such as new tokens launched by creators you follow

17. Changes to Terms

We may update these Terms from time to time. We'll notify users of major changes via email or platform notification. Continued use of TradePesa means you accept the updated terms.
